Definitions
For the purposes of these Terms and Conditions, the following words and expressions shall have the meanings assigned to them except where the context otherwise requires:
- "Airtime"means the actual usage and/or consists of the total airtime used making both incoming and outgoing calls via wireless phone and/or mobile phone and/or cellular phone.
- "AmMobile"means AmMobile services offered by AmBank Group to their customers to perform Banking transactions via mobile phone(s)/SMS in accordance to the terms and conditions stipulated in www.ambg.com.my/amonline/info/tnc.asp
- "Eligible participants"means all new and existing AmMobile users and/or customers who registered their Maxis mobile number(s) for AmMobile services during the Campaign Period and individual(s), person(s), company (ies), corporate or incorporate as stipulated in Clause 3 herein.
- "Hotlink accounts"means "Account" and/or "Hotlink accounts" (whichever is applicable) and/or other terms as may be defined in the relevant Hotlink Service Terms and Conditions in any relevant Maxis website(s).
- "SMS"means Short Message Service.
- "The Campaign"means the Hotlink Double Reload Mania Campaign organized by AmBank (M) Berhad in accordance to the Terms and Conditions stipulated herein.
- "Top Up"means the act of reloading via SMS sent to 32033 by the Eligible participants for the purposes of redeeming call credits.
Words denoting person shall include and body or persons corporate or incorporate. Words importing the singular shall also include the plural and vice-versa. Words importing the masculine gender shall include the feminine and neuter gender.
Campaign Period
The Hotlink Double Reload Mania Campaign ('the Campaign') is organized by AmBank (M) Berhad ('AmBank') which shall be valid from 13th September 2007 to 31st December 2007 ('Campaign Period') or such other period(s) determined at the sole and absolute discretion of AmBank.
Eligibility
The Campaign is open to all new and existing AmMobile users and/or customers who registered their Maxis mobile number(s) for AmMobile services during the Campaign Period. The following persons are ALSO ELIGIBLE to participate in this Campaign subject always to the terms and conditions stipulated herein: -
- Permanent and/or contract employees of AmBank Group (including its subsidiaries and related companies) and their immediate family members (spouses, children, parents, brothers and sisters); and/or
- Representatives, vendors and/or agents (including advertising and promotion agents) of AmBank Group and their immediate family members (spouses, parents, children, brothers and sisters).
(Hereinafter collectively referred to as 'Eligible participants')
Prizes
- An Airtime worth equivalent of Top Up amount and may not exceed RM100 (Ringgit Malaysia One Hundred Only) will be credited into the winner's Hotlink account i.e the Top Up amount is RM50.00 (Ringgit Malaysia Fifty Only), the winner will receive another RM50.00 (Ringgit Malaysia Fifty Only) credited into his/her Hotlink account.
- In the event of the winner is using a Postpaid, the Airtime will be credited into the Hotlink account(s) which has/have been reloaded (Top up) by the winner in accordance to the Terms and Conditions herein.
Selection Of Winners
- All Eligible participants must perform Top Up transactions by sending SMS to 32033 during the Campaign Period in accordance to the Terms and Conditions herein.
- The 88th (Eighty Eighth) successful reload (Top Up) transaction made by Eligible participant, daily throughout the Campaign Period shall be selected as a winner for the respective day subject to the Terms and Conditions herein and sole discretion of AmBank.
General Rules
- AmBank reserves the right to publish or display in any form it deems appropriate (including but shall not be limited to) the name(s), picture(s), identification number(s) and city of residence(s) of the Campaign winners for advertising and publicity purposes. By participating in this Campaign, the winner(s) hereby consent to and agree that AmBank shall be at liberty to publish their names, pictures, city of residence and identification numbers for advertising and publicity purposes.
- By participating in this Campaign, all Eligible participants consent to and agree to be bound by these Terms and Conditions and the decisions of AmBank and/or the organizers and judges.
- All transactions as recorded by Ambank shall be final and conclusive.
- In no event will AmBank be liable for any loss or damages, including without limitation to, loss of income, profits, goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties, howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Prizes and/or this Campaign. Even if AmBank has been advised of the possibility of such damages in advance, all such damages are expressly excluded.
- AmBank's decision on all matters relating to this Campaign shall be final and binding on all Eligible participants and winner(s) of this Campaign and no correspondence or appeal will be entertained.
- The Prizes will be credited into the winner(s)'s Hotlink account within 4-6 (four to six) weeks after the end of the Campaign Period.
- The Prizes are not transferable or exchangeable for cash, and are subject to the Terms and Conditions stated herein. AmBank reserves the right to add to and substitute any of the prize(s) with prize(s) of similar value without prior notice.
- AmBank makes no representation or warranties with respect to any prizes given in this Campaign and in particular, makes no warranties with respect to the quality of the prizes or their suitability for any purposes.
- AmBank shall not be liable for any misinterpretation of facts in respect of the prize(s) offered and published in any mass media, marketing or advertising materials.
- Winners of the campaign may be required to attend and participate in the prize-giving ceremonies and/or any events organized by AmBank, if any. If winner fails to attend such ceremonies and/or events, AmBank shall reserve the right to forfeit the prize (s).
- AmBank reserves the right to vary, delete or add to any of these Terms and Conditions herein at any time without prior notice
- AmBank reserves the right at its sole discretion to disqualify any Eligible participants that it determines to be tampering with the entry process or the operation of the Campaign, to be acting in breach or potential breach of these Terms and Conditions.
- AmBank reserves the right to cancel, terminate or suspend this Campaign at any time without assigning any reason with or without any prior notice. For the avoidance of doubt, cancellation, termination or suspension by AmBank of this Campaign shall not entitle the participants or Eligible participants to any claim or compensation against AmBank for any and all losses or damages suffered or incurred by the Eligible Participants as a direct or indirect result of the act of cancellation, termination or suspension.
- All terms and conditions stipulated herein shall be governed by and construed in accordance with the laws of Malaysia.
This Campaign ends on 31st December 2007. Any extensions thereafter will be determined at the sole discretion of AmBank.
